The big debate is whether Bill Cosby who was recently found guilty of 3 counts of aggravated indecent sexual assault will go to jail.
As an attorney with 30 years in the trenches this is my opinion.
The jury is done in this case. The defense team will employ their own experts to evaluate Mr. Cosby to suggest the judge should be lenient .
At sentencing the judge will hear from all the experts which will be two completely opposite viewpoints. The judge will determine whether BC should be punished and go to jail for his crimes that were committed 14 years ago. Factors to consider are that he is 80 years old, in poor health and perhaps suffering from dementia, as exhibited by his vulgar outburst in court. A long prison sentence would be a death sentence for BC. This is a state offense not a federal conviction so that chance of placement in a “ country club “ prison are very slim.
The defense will also argue all the good things Bill Cosby has done to show he was some benefit to society when he was not drugging and raping women.
The prosecution will argue that a prison sentence is long over due and he caused irreparable injury to dozens of women over the years . Since only one case was tried due to the statute of limitations , technically Ms. Constand should be the only one to address the judge and ask for the maximum sentence.
My best guess is that Bill Cosby will be sentenced to a prison sentence but that due to his poor health he will be released on a house arrest when his health falters. I envision large fines.
With the recent #metoo movement the judge will likely want to set an example to show that this abhorrent criminal conduct toward women will be dealt with harshly.
